  1. I.                    INTRODUCTION

 

www.wox.gr, (hereinafter the “Website”), is the website that hosts the Online Store with the trade name “www.wox.gr”, which exhibits, promotes and offers for sale products for cars/motorcycles, for kitchens/cooking, for health/beauty, electronics/electrical items, etc. through the Internet. www.wox.gr and the Website belong to the company named "VSL-STORES E.E", based in Patra, 14 Attalias street, 26334 (VAT: 802008702 / Tax Office of Patras), with GEMI number 168057716000, email info@wox.gr (hereinafter "wox.gr" or the "Online Store", the "wox", the "Business", "Company", "we", "us", "our"), which legally manages it.

These General Terms and Conditions of Use of the Website and Purchases, which include as an integral part and a single whole the General Terms of Purchase, the Privacy Policy and the Cookies Policy (hereinafter the "Terms of Use" or "General Terms" or "Terms"), define the terms and conditions under which you, in any capacity, i.e. as a navigator/visitor, user of the Services, consumer - buyer, Member, (hereinafter the "User", the "Consumer", "you", "your") browse our Website, use its content and Services (e.g. Member Registration, Newsletters), or/and transact in our Online Store, making purchases and govern the sales contract you enter into with wox for the purchase of products from our Online Store.

Before entering the Website and using its Services or making purchases in our Online Store, we invite you to consult the Terms and Conditions and make sure that you agree with them. In case of disagreement with any of these Terms and Conditions, you must not take any action, use any Service of wox, including simply browsing our Online Store. However, if you wish for clarification or information regarding the Terms and Conditions, or if you have any disagreement, reservation or question about them, you can contact the wox Customer Service Department, using one of the contact methods mentioned in the relevant section "Contact", before performing any action on wox. 

In case you disagree with any term or/and with all of them, you must not use any of wox's services, nor purchase products. However, by any action you take on our Online Store, such as, for example, browsing it, registering as a Member or subscribing to our Company's Newsletter or purchasing our products, you certify that you have read, understood and unconditionally accepted the Terms and Conditions.

Your regular visit to the Website to monitor any changes to the Terms and Conditions is necessary, as wox reserves the right to unilaterally modify, renew, upgrade, delete, add, restrict a) these Terms and Conditions, in whole or in part, b) its Policies, c) the provided Services, d) part or all of the external appearance (interface), structure or composition (configuration), as well as the technical specifications of the Website, e) part or all of the content and products of wox, the products offered for sale, i.e. to permanently or temporarily cease the sale of products (some or all) of specific or all suppliers (hereinafter the "Changes") at its absolute discretion or/and when any change as above is imposed by law, possibly without prior notice or your consent, always however within the framework of business ethics and the limits set by law. Wox undertakes the obligation to inform you about any changes as above, through the Website, which will be valid from the date of their posting on this Website. It is clarified that any change to these Terms and Conditions does not cover orders or other transactions and uses of services that you have already carried out before the entry into force of the Changes as above and our Company has accepted. However, if you wish for clarification or information regarding the changes, or if you have any disagreement, reservation or question about them (changes), you can contact the wox Customer Service Department, using one of the contact methods mentioned in the relevant section "Contact", before performing any action on wox. Any action, use or transaction on wox after the Changes as above, is considered as unconditional acceptance of them.

Please note that any information/clarification provided to you as above by our Customer Service Department regarding the Terms and Conditions does not constitute a replacement, substitution or any modification of the Terms and Conditions, as they are provided solely to assist you, and the Terms and Conditions constitute our sole and exclusive agreement. 

Wox reserves the right at any time, without reason and without prior notice to the User, to cancel, suspend or terminate the operation of the Website/online store or certain Services or the marketing of certain Products.

Your use of this Website and any transaction in our Online Store is at your sole risk.

BY ACCEPTING THESE TERMS AS ABOVE, USERS EXPRESSLY AND UNCONDITIONALLY DECLARE THAT THEY ARE OF LEGAL AGE TO BE BOUND BY THESE GENERAL TERMS REGARDING THE USE OF WOX'S SERVICES AND PRODUCTS TO WHICH THEY PROCEED.

 

 

II.            GENERAL TERMS OF WEBSITE USE

  1. 1.                   PROVISION OF GENERAL INFORMATION

             The information provided by wox is complete, true, valid and up-to-date, whether it concerns our identity or the products offered by our online store (e.g., product descriptions). However, the above guarantees are subject to any technical or typographical errors, which cannot be foreseen or have occurred inadvertently or due to malfunctions of this website or due to force majeure. The Company does not guarantee the accuracy or reliability of any information or content regarding any products or services or software included on the Website. 

             Our Company, responding to the need of the Website users for information, provides you with articles and generally varied content. This information is provided for your simple information and should not be taken as specialized advice or an exhortation to purchase a specific product. The Company bears no responsibility for any damage that may occur to a user/customer or third party, due to or on the occasion of information received from or posted on the Website.

 

  1. NEWSLETTER SUBSCRIPTION

Your subscription to the wox newsletter service is voluntary and is not a mandatory process for making a purchase from the Online Store. However, those who create an account on wox (hereinafter "Members") will be able to receive our newsletters and other promotional material at the email address they provide during this process (account creation). Subscription to the wox Newsletter Service is also possible for non-Members, and is completed by entering your email address in the corresponding field on the Website. By completing your subscription to the wox Newsletter Service, you give us your express consent for wox to send you informative and promotional material about its products and services or/and those of other online stores of our company, as well as related advertising messages.

Wox is not responsible if Newsletters are not delivered to their destination, although it makes every possible effort with ISP's (Internet Service providers) for their delivery. Newsletters may end up in the spam folder, so please check regularly that they are not stored there. In case you no longer wish to receive informative Newsletters or wish to unsubscribe completely from the wox news sending system, you can inform us using the contact form on the Website or through the corresponding link that appears in our informative emails you receive.

The Company reserves the right to advertise on various websites of its choice on the Internet and to use partners or third-party advertising companies, as appropriate. 

Our Company reserves the right to display third-party advertisements through the Website. Advertisements may contain external links to third-party websites. The Company does not guarantee the accuracy or reliability of any information or content regarding any products or services, software or advertisements included on the Website, nor for third-party content to which you are referred via hyperlinks from the Website or to which the Website provides you access. At wox, we make every effort to take all appropriate measures to ensure that advertisements and their content are lawful, do not infringe on third-party rights, are not offensive, false, fraudulent or misleading, and prohibit the posting of advertisements on the Website with themes or content that are abusive, threatening, pornographic, nude, alcohol-related, drug-related, cigarette-related, gambling and betting-related, weapons-related, explosive-related, virus or other inappropriate software-related, pyramid schemes-related, illegal activities-related, or any other inappropriate content at its absolute discretion. All advertisements are checked to be appropriate for our community and to respect the rights of third parties, whether natural or legal persons. However, no advertisement can imply endorsement, approval or partnership with wox. In addition, all appropriate measures are taken to identify any advertisements that violate the above and are contrary to the law; however, we do not guarantee the suitability and legality of such advertisements, and our Company may, at any time, reject any advertisement for any reason it deems appropriate, even after its publication.

The Website and its individual pages may contain links to websites maintained by third parties, whose information and data protection practices differ from those on wox. Wox and our Company bear no responsibility for the information or data protection practices used on third-party websites. It is recommended, before using other websites, to read and understand their terms of use and their privacy policy. Our Company does not control the availability, content, personal data protection policy, quality and completeness of the services of other websites to which wox may refer via "links", hyperlinks or advertising banners. Our Company should in no case be considered to endorse or accept the content or services of the pages to which it refers, or to be connected with them in any other way.

 Users and Members may follow our Company through its pages on Facebook, LinkedIn, Instagram, Twitter, Pinterest, YouTube (hereinafter “Social Media”) to learn its news, comment and participate in its special promotional activities. Any products or services we offer through Social Media and all information shared, submitted or offered through its Social Media accounts, will be subject to these General Terms, unless otherwise agreed. In addition, any interaction you have with Social Media may allow access and connection to your personal Social Media accounts. We have no access to these, nor do we control these services and therefore we are not responsible for the actions or/and omissions of social networking service providers. For this reason, we recommend that you carefully read the terms of these social networks. The company bears no responsibility for any actions or omissions of any social networking service provider or for your use of the features included in their platform. For any issue arising due to or on the occasion of the use of social media, the user must address them directly and not the company.

 

 

  1. 7.              PRODUCT SEARCH RESULTS BASED ON SEARCH CRITERIA

The Online Store provides the user with the ability to search for Products based on the criteria selected by them using a special search tool. This tool is provided solely for your convenience in navigating wox and searching for products. The Company bears no responsibility for the automated results derived from the use of the aforementioned tool, nor for the suitability of the products for the user's desired purpose. The user uses the tool at their sole risk regarding the results, their accuracy and correctness.

 

 

III.           GENERAL TERMS OF SALE - PURCHASE THROUGH THE ONLINE STORE (B2C)

Orders placed remotely are made through the online store and by phone. Our Company also receives and processes orders placed by email, or through its Social Media pages. In addition, any reference to a desired product in the return form is not considered an order. Therefore, the following General Terms concern the terms and conditions under which sales - purchases are made both through our Online Store and by phone (hereinafter "General Terms of Purchase"). The Seller is the Company.

Through the Company's online store, third-party products are available for sale to you either in your capacity as a supplier or in your capacity as a consumer.

To avoid any misunderstanding, in case the buyer wishes to receive an invoice, then they are automatically recognized by our system as a "supplier", while if they are a natural person and wish to receive a receipt, then they are automatically recognized by our system as a consumer.

 

 

  1. 1.                   THE PRODUCTS

Wox, through its Website, displays, promotes and offers for sale to consumers (B2C) our Company's products, such as car/motorcycle products, kitchen and cooking items, health and beauty products, electronic and electrical materials, etc. (hereinafter the "Products").

We strive to ensure that the information accompanying the Products displayed on wox is complete, true, valid and up-to-date, and that their photographs constitute a real, realistic and accurate depiction of our Products. However, the photographs depicting our Products may deviate from the actual state, form, size, color and general appearance of the products sold. The Company bears no responsibility for any discrepancy between the photographic depiction of the Product and its actual image and we reserve the right for any technical or typographical omissions or errors that cannot be foreseen or have occurred inadvertently or due to malfunctions of this Website or due to force majeure.

Specifically regarding the information provided on product availability, wox has taken all necessary technical and other measures to immediately update the availability of our Products; however, it explicitly reserves the right regarding the validity of the Products available in the Online Store, as their update may take place within one (1) hour from the time of their modification. Specifically for any errors in the prices of our Products, the provisions of Section III.C.2.5 below apply.

Wox reserves the right to choose, at its sole discretion, the Products it will offer for sale, and may from time to time withdraw or renew them freely and without obligation of notice, your consent, or simple notification. The same applies to any offers, discounts, and pricing policies it follows from time to time, as this determination is at our exclusive discretion.

All products are available for personal use only and not for commercial use, such as resale.

  1. 2. ORDER

2.1 Submitting an order - Completion of sale contract

Use the categories located in the main MENU of the Website, navigate through it, and find what you are looking for.

Check the Products you wish to purchase in your shopping cart by clicking on the "MY CART" link/icon located at the top right of the Website. You can use the remove/delete button to remove Products from your cart before completing your order.

To complete your order, you must provide us with certain personal information essential for processing your order, payment, and shipping information for the Products, etc. This information includes: first name, last name, email, phone number, postal address (street, number, city, postcode), and your card details if you choose to pay by credit card.

Registering as a Member on wox to open your personal Account is not a prerequisite for submitting your order and making a purchase from our Online Store. However, opening your own Account allows you to access your order history, payment method, the value of each order, and a list of your favorite Products from our store.

The process of registering as a Member and opening your Account on wox is quick and simple: you provide your first name, last name, VAT number, email, phone number, address details, and login password. Registration and participation as a Member are free, personal, non-transferable, and non-assignable. You are responsible for the information you provide to us, and wox relies solely on your declarations regarding your personal data. The personal data you provide during your registration as a Member is processed by our Company exclusively for the purpose of creating your Account on wox, for serving you regarding the purchase and delivery of the Products you buy from our Online Store (e.g., to ensure communication with you, to complete, send, and deliver your order, for payment and our secure financial transaction, and for sending you the purchased Products) and additionally for sending you our newsletters and other advertising, promotional communications. Regarding the collection and processing of your personal data, the terms and provisions of the Privacy Policy of wox apply, which Terms and Policies you declare that you have read, understood, and accept fully and unreservedly. All your personal data collected through the specific electronic form is absolutely necessary for the performance of the above transactions, and your registration signifies your full consent. In case of changes in your data, you must immediately inform us of your new details so that they are always complete and truthful. By registering as above, you give your explicit consent to the collection and processing of your data based on these General Terms of Use and Purchase and the Privacy Policy of wox.

You have the ability, at any time, to access your data, or you can also at any time request the immediate deletion or correction of your data, their temporary non-use by wox.gr, their blocking or non-transmission, by following the procedure defined in the Privacy Policy. In any case, your data is retained by wox only for as long as you are a registered Member.

Membership is only possible for natural or legal persons with full legal capacity. Minors (persons under 18 years of age) are excluded from acquiring Member status.

Once you have placed the final Products in your "MY CART", you have one more step to complete the submission of your order: clicking the "COMPLETE ORDER WITH PAYMENT OBLIGATION" button.

Your orders can be placed at all hours of the day and on a daily basis without exception.

By filling in your details as above and clicking the "Complete order with payment obligation" button, you will see the total of your order with its full details, including payment and shipping information. If you agree, you have one more step to submit your order: clicking the field with the acceptance of these Terms of Use and Purchases and the Privacy Policy. Once the terms and Policies of our Company have also been accepted, you click the "COMPLETE ORDER WITH PAYMENT OBLIGATION" button, at which point your order has been completed and submitted to our company.

You are obliged to state your full and true details when submitting your order. Upon completion of your order submission, you declare that you are a legal/authorized user of the credit or debit card you declare to us and that there is a sufficient available balance to cover the value of the Products you purchase. Our Company may (without being obliged) check the payment details you declare to us when you choose credit card or third-party Online payment providers as a payment method, in order to ensure our financial transactions. In case any discrepancy, error or any other existing or potential problem is found, it may, at its absolute discretion, reject your order.

Once you submit your order, you will then connect with our payment provider, depending on the payment method you choose. You can pay by one of the methods listed below in Section III.5. In any case, any price that may have been reserved or prepaid (such as, for example, if you choose to use PayPal or another method) will constitute an agreed financial guarantee and not yet payment of the price, which payment will be paid only if the availability of the product and the price are confirmed and the sales contract is completed, otherwise the price will be refunded to you.

Subsequently, an automated message will be sent to the email account you provided during the submission of your order, informing you that we have received it, listing the Products you have ordered, all the terms of the order, and your order number. The sending of the aforementioned e-mail is merely a message confirming receipt of the order by the Company and not an acceptance of your order or the conclusion of a contract with the Company. The order is received by the Company subject to verification of the availability and correctness of the price of the ordered Product, after communication between the Company and its suppliers. Therefore, at this stage, the contract between the buyer and our Company has not yet been concluded. It is noted that: a) in case you have chosen cash on delivery as a payment method, the order confirmation as above will be sent to you upon submission of your order, and the Products will be delivered to you only upon full payment of the Products upon their proper delivery to you, b) in case you have chosen to deposit the order amount into a wox bank account, your order will not be executed until the corresponding amount is credited to our Company's account.

Once the ordering stage is completed as described above, wox then examines whether it (the order) can be executed as is and if there is no reason for its rejection according to the present terms. If it is deemed that it can be processed in its entirety, the process of sending your Products to our collaborating courier company or another collaborating company is initiated, at which point we will send you another message to the email account you provided during the submission of your order, which will constitute the Company's acceptance of your submitted proposal for the conclusion of a contract and therefore constitutes a declaration of acceptance of your offer and the conclusion of a contract with the company, and will notify you of the bill of lading/shipment number. With this number, you can track the progress of your order until it reaches the delivery location you specified in your respective order.

Delivery time depends on many factors, such as, but not limited to, the delivery location, the quantity of products, etc. The delivery cost is fixed regardless of the quantity of products or the delivery location. For more information regarding delivery time and shipping costs, please visit Sections III.3 and III.4 respectively.

In the event that, upon receipt of your order, we discover any sudden shortage of one of the Products you have ordered, or an unexpected delay in its delivery, or its temporary unavailability, or any other issue/problem that makes your order partially acceptable and executable by us, e.g., a force majeure event, such as extreme weather conditions, strikes, or any other event outside our sphere of influence and control that may affect the transport and delivery of your order, or a lack of sufficient stock, we will contact you immediately using the contact details you provided when submitting your order to agree with you on any modification, correction, and/or cancellation of your order. We hope to communicate with you; however, if this is not possible within two (2) days from the date of completion of your order, we will send you an email with the part of the order that wox can execute, and the remaining part of your order that cannot be executed by us will be canceled without you incurring any extra charges that may arise due to the modification or partial cancellation of the order. Therefore, based on the above, the new email we send you will constitute notification of receipt of your order, and our Company will be obliged to execute it as stated above. If the total amount of the submitted order has been reserved or prepaid, our Company will refund the amount corresponding to the canceled Products as soon as possible.

Important legal clarification: Our sending of your order confirmation as described above, although it refers to the voucher number that your order will receive from the transport company, does not constitute acceptance of your order on our part, but simply a confirmation - notification that we have received it. The order you submit to wox constitutes a proposal on your part to our Company to purchase the Products listed therein. In order for a sales contract to be concluded between us, we must in turn accept your order, as is. Such acceptance is made by us when we send you the message (email) confirming the shipment of your order, as is. It is clarified that in case the order shipment confirmation message does not include some of the Products included in your order, these Products do not form part of the sales contract between us. However, the Contract is executed only if the Products are paid for, i.e., once your card is credited, our account is credited with the equivalent amount in the case of a bank deposit, or your order is paid for in the case of cash on delivery.

2.3 Telephone orders

You can place your order by phone at wox at the phone numbers listed on the wox page. Telephone orders can be placed Monday - Friday from 09:00 - 21:00 and Saturday from 09:00 - 14:30. During your phone call, you describe the Product you wish to order and provide us with the payment and shipping details listed on our page and described herein. The same payment methods apply to telephone orders. In the case of a telephone order, you will provide us with a valid email address and a mobile phone number in order to receive the legally required communication regarding the confirmation of your order and its progress. By submitting a telephone order, you accept these Terms and Conditions and the Policies included therein, such as the Privacy Policy. Otherwise, these Terms and Conditions apply.

2.4 Order Cancellation

2.4.1 Order Cancellation by User

In addition to other cases mentioned herein, you can cancel your order in the following cases:

Beyond the option you have before submitting your order to technically remove the quantities of Products you do not wish to order from your cart by clicking the "X" button, which activates the removal of the corresponding Products, you can cancel an order you have submitted to us in the following cases:

After notification of receipt of your order but before confirmation of acceptance with notification of product shipment and for a period of two (2) hours, you can cancel your order by sending an email to info@wox.gr or by phone, Monday-Friday: from 09:00 – 21:00 and Saturday from 09:00 – 14:30. The email is considered to have been received by us for the purposes hereof, the next business day from the date of its dispatch, and we may cancel your order as above, only if the receipt of your relevant message occurs before sending you the confirmation of your product shipment.

Furthermore, in the event that wox modifies your order in accordance with the provisions herein, you have the option to cancel your entire order or the part of it that cannot be executed by us.

2.3.2 Order Cancellation by wox:

In addition to other cases mentioned herein, wox may cancel your order and/or the sales contract at any stage in the following cases:

  • Due to a technical error, the Product you ordered is not available and the system has not been updated in time, or/and when it is no longer possible for our Company to procure it for any reason.
  • Due to a technical error, the price or description of the Product is incorrect.
  • In our sole discretion, we believe you are involved in unfair practices by submitting the order, or when you are not making fair use of the wox ordering system.
  • Non-payment.
  • Non-receipt of Products in accordance with the terms herein.
  • The execution of the order violates laws, rules, and regulations.
  • In cases of force majeure.

In the event that the Product of the canceled order has been paid for, wox will refund your money without undue delay.

2.3.3 Cancellation after product receipt

After receipt of the Product, the order is cancelled by exercising the Right of Withdrawal in accordance with the provisions of Section III.6 below. Any refusal on your part to receive your Products upon delivery by the transport company is equivalent to withdrawal, a right for the exercise of which the provisions of Section III.6 below apply.

2.5 Prices

2.5.1 Listed price

Although wox takes every reasonable technical and practical measure to ensure the accuracy and correctness of the prices listed for the Products in our online store, there is a possibility that due to a technical error, an error may appear in the price of one or more products included in your order. Upon receipt of your order and before we receive payment, we will check the prices of the ordered Products. If an error is found in the price of a Product you have ordered, we will contact you as soon as possible and in any case before dispatch. It is at your discretion to proceed with the order at the correct prices, to modify it taking into account the correct prices, or to cancel it. If we are unable to contact you, we will consider the order canceled.

The prices listed for all our Products are in euros, include VAT, and are considered final. For detailed information on our charges, please refer to Section II.4.

The listed prices do not include additional required shipping charges, which are added before your order is completed, nor do they include deductions or any retentions provided for organizations, Authorities, bodies, etc.

The Company generally reserves the right to freely adjust product prices, to modify them, and to change or/and withdraw offers at any time without prior notice to users, who will be informed of the current price by the relevant price posting of the product on the Website.

3 PRODUCT DELIVERY

3.3 Delivery location

Products are delivered to the address provided during the order, within Greek Territory.

If the products weigh more than 10 kg, they are delivered to the ground floor entrance of the declared delivery address. The consumer is responsible for carrying the product to an upper floor.

3.4                Delivery Method and Time

The shipping time of the Products you have ordered depends on many factors, as delays may occur for reasons beyond our responsibility. See Section III.3.5 below for what applies in case of delivery delay. Products are mainly shipped via courier services or by a transport company for bulky packages. When requesting your order, you can choose to pick up the Products yourself or have them shipped to you. Specifically, the following apply, subject to force majeure and reasons not attributable to our fault:

Subject to what is explicitly defined in these Terms of Use, products are delivered within Attica within one (1) or two (2) business days.

For information regarding shipping costs, please refer to Section III.4 "Shipping Costs".

Note: Orders placed by 14:00 are processed by us on the same day, while orders placed after this time are processed on the next day. Orders placed on Saturday after 13:00 and throughout the weekend are processed on Monday.

The above deadlines do not apply during periods of extreme weather conditions or strikes and in any case of force majeure, which may affect transportation and delivery times.

Please note that because orders are linked to the online system of our partner courier company when invoiced, it is not possible to send your products with another courier company of your choice. In case of a problem or query, please contact customer service at info@wox.gr.

Product deliveries by ACS courier are carried out from Monday to Friday from 09:00 to 21:00 and on Saturday from 09:00 to 14:00. Saturday deliveries require an extra charge of 3.00 euros in addition to the required delivery cost and must be declared when ordering.

 

3.5                Delivery Delay

Our Company makes every possible effort for the timely and proper delivery of your Products, however, we reserve the right that the delivery of your Product(s) may be delayed in cases, for example, where (a) the Product has been delayed in being sent by our supplier due to, for example, a transportation jam, force majeure, etc., resulting in us not having it in our warehouses when we expect to, (b) there is an event of force majeure, such as extreme weather conditions, strikes, or any other event beyond our sphere of influence and control that may affect the transportation and delivery of your order, (c) there is insufficient stock. In the above cases, we will contact you to ask if you want us to deliver the order without the delayed or unavailable Product, or to suggest an alternative, or to inform you about the delivery time of the Product that is not immediately available. If you are not satisfied with our proposal, you have the right to cancel the order in whole or in part and we will refund any money you have paid, and in any case, to provide you with the alternative solutions available from our Company. In case of delay, you can contact our Company at or at the email address info@wox.gr, where you can declare the cancellation of your order in whole or in part.

 

 

3.6                Responsibility during delivery

We inform you that our Company remains solely responsible for any damage or loss of your products until you (or third parties you have authorized) acquire physical possession of the Products.

 

If you are not at the declared address on the specified delivery date to receive the Products, our couriers, i.e. ACS, will attempt two (2) more times, on the next business days, to deliver your order. If the shipment is ultimately unsuccessful, our Company will attempt to contact you by phone, and if this is not possible, your order will automatically be returned to us and recorded as a Refusal. It is expressly agreed and as an exception to the general rule of our liability, you bear the responsibility for loss or damage to the Products, and the Products are stored according to the terms of the transport company and at your expense.

 

We note that our Company maintains a special list of customers who have placed orders and have not received their Products (have refused or are not at the delivery address at the agreed time) or who have made high-value purchases (over 200 Euros) and have refused delivery even once. Orders from customers registered on this list, for which cash on delivery has been selected as the payment method, are canceled even if they have been successfully completed. If these customers choose one of the other payment methods, either by bank deposit or credit card, their order will be shipped normally.

 

The Company cannot guarantee the timely delivery of products to the customer when delivery is made via the courier company.

 

  1. 4.               SHIPPING COSTS

For deliveries within Greece where our Company primarily cooperates with ACS, consumers are charged with shipping costs which are determined upon completion of the order.

 

  1.            PAYMENT METHODS

The following payment methods are available. You are required to choose one of the following methods for each purchase, as combined payment methods for the same order are not possible. Payment by installments is not possible.

 

5.1                Cash on Delivery Method

Payment upon receipt of the order. When the courier company's employee arrives at your place to deliver your products, you pay the value of your order. According to the applicable tax provisions, for payments over 500 Euros if you are a consumer, or over 50 Euros for professionals/suppliers, or according to the currently permitted cash payment limit based on current legislation, you cannot use the cash on delivery method, as cash payment is not allowed, and you will therefore have to choose another payment method.

5.2           Payment via PayPal

Your transactions in our online store are protected by state-of-the-art online SSL security systems.

5.3 Bank deposit

You can deposit the total cost of your order to the Company's bank account below, always stating your order number as the reason for the deposit to avoid processing delays. The account number is:

You can choose to pay by credit or debit card at the ACS store upon receipt of your order. This means you will need to go to the ACS store where your order is located and pay there using a credit or debit card. If you choose to pay by credit card, you must be present when picking up your order, with your credit card and your ID. In this case (i.e., payment by credit card), a third party is not allowed to pick up the order.

For pick-up from our premises, the credit card holder must present their credit card and ID. The same applies if you are ordering on behalf of a company. In this case, the card must be a corporate card and the name of the recipient must be written on the card.

6. WITHDRAWAL

  1. Electronic request for return, withdrawal or cancellation

    The customer can request a return, withdrawal or cancellation of an order through the electronic process of wox.gr.

    To submit a request, select the "Returns / Withdrawal" link at the bottom of our website and log in with the email you used for your order.

    The return request can be submitted within 14 days from the order delivery date. For orders that have not yet been shipped, you can submit a cancellation request until the shipment is completed.

    The cost of return is borne by the customer, unless the return is due to a wrong shipment, a defective product or other fault of wox.gr.

    6.1 Conditions for exercising the right

    You have a period of fourteen (14) calendar days to withdraw from any purchase you may have made through our online store, without stating reasons or providing us with any explanation regarding your desire to return the product or products.

    The aforementioned period of fourteen (14) calendar days for exercising the right of withdrawal begins on the day after you, or a person you may designate to us as responsible for receiving your products, other than the carrier, acquire physical possession of the products.

    In the event that you have ordered more than one product with a single order and they are delivered separately, the period for exercising the right of withdrawal begins on the day after you, or a person you may designate to us as responsible for receiving your products, other than the carrier, acquire physical possession of the last good.

    In any case, if the deadline falls on a weekend or public holiday, the deadline is extended until the next working day.

    6.2 Procedure for exercising the right

    To exercise the right of withdrawal under Article 6.1 above, you must, before the expiry of the deadline for its exercise, in accordance with the above, inform us of your decision to withdraw from the Sales Contract we have concluded, with a clear statement, which you can submit in one of the following ways:

    • electronically, via the "Returns / Withdrawal" link at the bottom of our website,
    • by email to info@wox.gr,
    • via the "Contact" section on our website,
    • by telephone communication with the Company's Customer Service department.
    • Upon electronic submission of the withdrawal request, our Company will send you without delay, to the email you provided during the completion of your order, confirmation of receipt of your request.
    • 6.3 Consumer obligations upon withdrawal
    • To meet the withdrawal deadline, you must send us your statement of exercise of the right of withdrawal before the withdrawal period expires, as set out herein.
    • In case of exercising the right of withdrawal in accordance with the above, you are obliged to return the product from which you are withdrawing the purchase immediately, without undue delay and in any case within fourteen (14) calendar days from the day you notified us of your decision to withdraw from the sales contract.
    • The deadline is deemed to have been met if you send back the products before the end of the fourteen (14) calendar day period. Products should only be returned to our Company's address stated in these terms or to the address indicated by our Company during the processing of the return request.
    • The exercise of the right of withdrawal is, by law, your obligation to prove to us its timely exercise, i.e. the date on which the withdrawal request was submitted to our Company, in order to calculate the legal deadlines arising from this and the law.
    • You bear the cost of returning the products from which you are withdrawing the purchase. The cost depends on the price list of the respective courier or transport company you choose, unless the return is due to an incorrect shipment, a defective product, or another fault of wox.gr.
    • The buyer is legally responsible for any decrease in the value of the products resulting from handling other than what was necessary to ascertain their nature, characteristics and functioning. To determine the nature, characteristics and functioning of the products, the buyer must handle and inspect them in the same way as they would be allowed to do in a physical store, and no more than that.
    • For a return to be accepted, the product sent for receipt by the Company must cumulatively:
    • be in the condition in which it was received,
    • if its original packaging has been opened, it must be intact, without damage or tears, and must be returned with the product,
    • be complete,
    • be accompanied by all documents, accessories, peripherals, and receipts that accompanied the product upon delivery.
    • If the product is not accompanied by its documents, the Company may not be able to identify the product with a specific order.
    • The Company reserves the right to check the condition of returned products. In the event that the products show dirt, damage, scratches, creases, incomplete packaging, or generally signs of use beyond what is necessary to ascertain their nature, characteristics, and functioning, the Company may reduce the returned value, in accordance with applicable law and these terms.
    • 6.4 Company obligations
    • Subject to what is expressly set forth herein, if you withdraw from a purchase in accordance with the provisions herein, we will refund the money we received from you, including any initial delivery costs, excluding supplementary costs resulting from your choice of a delivery method other than the least expensive type of standard delivery offered by us.
    • The refund will be made without undue delay and, in any case, within fourteen (14) calendar days from the day on which we were informed of your decision to withdraw from this contract.
    • We are entitled to delay the refund until we have received the goods back or until you have provided proof that you have sent the goods back, whichever occurs first.
    • The refund will be made using the same payment method that you used for the original transaction, unless you have expressly agreed to a different refund method. In any case, you will not be charged any fees for the refund.
    • Specifically, if the purchase of the product from which you are withdrawing was made by cash on delivery, the refund will be made by crediting the bank account you provide us with when exercising your right of withdrawal. If the payment was made via PayPal or another electronic payment method, the money will be refunded, where technically feasible, to the same payment method used for the original transaction.
    • You have the right, but not the obligation, alternatively to a refund, to choose to credit the corresponding amount to your account in our online store, provided this is available and if you expressly request it during your communication regarding withdrawal.

    6.5 Product returns due to withdrawal

    In the event of withdrawal as per the above, it is clarified that any products you have purchased as part of an offer, gift, or discount linked to the purchase of the product from which you withdraw, must be returned along with the main product, provided that their return is necessary for the completion of the withdrawal process according to the terms of the respective offer.

    You acknowledge that you are responsible for any decrease in the value of the products you return, which occurs as a result of your handling of the products, beyond that which is necessary to ascertain their nature, characteristics, and functioning.

    The consumer should handle each product received in the manner they would handle and examine it in a physical store, in order to ascertain its nature, characteristics, and functioning.

    All products must be returned in good general condition, clean, and with all accessories, parts, documents, and packaging that accompanied them upon delivery. Furthermore, the returned product must be accompanied by all necessary documents received with its delivery.

    The consumer may be charged for a reduction in the value of a product if their handling of it exceeds the acceptable measure for ascertaining the nature, characteristics, and functioning of the product. Products returned without packaging, with damaged packaging, with deficiencies, damage, or signs of use beyond necessary inspection, may be subject to a reduction in the refunded value, in accordance with applicable law and these terms.

    6.6 Cases where the right of withdrawal does not apply

    The right of withdrawal does not apply in cases excluded by applicable law.

    By way of example, the right of withdrawal does not apply to products which, for reasons of health protection or hygiene, are not suitable for return if they have been unsealed after delivery, such as, but not limited to, cosmetics, personal care items, and underwear, if their packaging has been unsealed.

    Furthermore, the right of withdrawal may not apply to products manufactured according to the customer's specific specifications or which are clearly personalized, as well as in any other case provided for by applicable law.

7. INCORRECT ORDER EXECUTION – DEFECTIVE PRODUCT

7.1 Consumer Rights. Procedures for Exercising Rights.

In the event of an incorrect or defective product being sent, you have the right, within 14 days of receiving the product, to contact us by phone and report the defect in the product or our mistake in executing your order and inform us of your desire for the product to be replaced with the correct/non-defective product or for us to refund your money.

Our Company undertakes to cover the total cost of return and re-shipment of the correct/non-defective product, provided that the return of the incorrect/defective product and the shipment of the new one are carried out via ACS. If, for any reason whatsoever, you wish to use another return/shipping method, you will bear the additional cost resulting from your chosen transport method compared to the corresponding cost of ACS.

You expressly acknowledge and accept that product replacement is subject to the availability of the correct/non-defective product at the time you inform us. If replacement is not possible, we will refund all money received from you, including any delivery costs (excluding additional costs due to your choice to use return/delivery methods other than the cheapest return/delivery method we offer), subject to the provisions expressly set out below. The refund will be made immediately, without undue delay and in any case no later than 5 days from the date the Company receives the products you returned as described above and subject to the provisions of Article 6.5. You expressly agree that the replacement of incorrectly ordered products will take place provided that the product to be replaced is returned to our Company in the same good condition as you originally received it. Our Company does not replace products that are dirty, damaged, bruised, other than the reported defect, or are not accompanied by all documents (receipt, return form, accompanying product documents) that you received from us. In the case of returning a defective product, the Company reserves the right to withhold replacement or refund your money if it does not have sufficient evidence to hold it responsible for the product's defect.

The refund will be made by crediting your bank account, which you will notify us of when exercising your right of withdrawal. In any case, no charges will be incurred for such a refund.

Claims for compensation or monetary satisfaction of any kind and legal basis are excluded, as are any claims for damage to health, life, and physical integrity.

The Company is responsible for actual defects and lack of agreed properties according to Article 5 of Law 2251/1994 and Articles 534 et seq. of the Civil Code. Based on these provisions of the Civil Code, the following rights apply to you if the product has a defect or a lack of an agreed property: a) the right to request repair or replacement of the product (without charge to you) with another, or b) the right to request a reduction in the price, or c) the right to withdraw from the sales contract you have concluded with the Company, provided that we are talking about a material defect. These rights are provided alternatively without hierarchical ranking between them, i.e., without some of them having priority. You can exercise these rights for a period of 2 years from the delivery of the product to you, even if you discovered the defect or the lack of an agreed property later. That is, you are entitled to exercise your rights from the moment of delivery of the item and for 2 years, if an actual defect or lack of an agreed property manifests itself within this period.

IV. RESPONSIBILITIES – OBLIGATIONS OF THE PARTIES

  1. Exclusive Responsibility of User/Consumer.

You are solely and exclusively responsible for the lawful use of the Website and the Online Store and you are obliged to refrain from any illegal act and abusive behavior, as well as from the adoption of illegal practices and unfair competition practices.

You are exclusively responsible for the legality and accuracy of the Information, Data, and details you provide to wox, which the Company has no responsibility or obligation to check, unless required to do so after a complaint or by law.

  1. Prohibited Uses - Restrictions on accessing and using the Website

  1. 2.              Confidentiality of Transactions

 

Maintaining confidentiality is considered self-evident. The same basic principles that govern traditional transactions also apply to e-commerce. All information transmitted by the user/member to wox is confidential, and wox has taken all necessary measures to ensure that it is used only to the extent necessary within the framework of the services provided. Some of the measures taken are as follows:

  • Only authorized employees have access to your transaction information and only when necessary, e.g., to process your requests.
  • wox does not disclose customer and transaction data, unless it has your written authorization or this is required by a court order or decision of another public authority.
  • In the event that wox uses third parties to support its systems, it ensures the maintenance of confidentiality.

For your own security, you should also treat all information provided through the service as confidential and secret and not disclose it to third parties.

  1. Final Terms

These General Terms constitute the final and sole terms in force regarding the provision of the Service by the Business to the User and supersede any previously existing terms, previous agreements and arrangements, written or oral, between the Business and the User regarding the use of the Service.

  1. Waiver

No delay, negligence, or forbearance by the Business in enforcing compliance with any of these terms by the User shall constitute a waiver or prejudice any right of the Business provided for herein. If any present term is deemed invalid and consequently unenforceable by any competent Court or Authority, this term shall not invalidate the remaining terms of this document, which shall remain in full force.

  1. Invalidity of terms

In the event that any part of this document is declared or determined by a court decision to be invalid, such invalidity shall not affect the validity of the remaining part of this document, which shall remain valid as if these General Terms had been executed with the invalid part deleted. The Business will seek to replace any invalid term with a new valid term, the effect of which will be the closest equivalent to the one invalidated.

 

  1. Applicable Law - Jurisdiction

 

Any dispute between the contracting parties regarding the application, interpretation, invalidity of contract terms, the existence or non-existence of rights and obligations of the contracting parties arising from contract or tort, shall be interpreted according to Greek laws. As consumers, you can resort to ADR entities, which meet specific quality criteria, for any kind of dispute you have with suppliers of goods or services, regardless of what you bought (with the exception of health services and higher education) and how you bought it (electronically or not, domestically or cross-border), and falls under the exclusive jurisdiction of the competent courts of the city of Athens, to whose jurisdiction the parties voluntarily submit from today.

 

According to Directive 2013/11/EC, which was incorporated into Greek law with Ministerial Decision 70330/2015, the possibility of online resolution of consumer disputes through the Alternative Dispute Resolution (ADR) procedure is now provided for throughout the European Union. If the customer is a consumer and has any problem with a purchase made from wox, they can initiate the ADR procedure through the single pan-European platform for online dispute resolution (ODR platform) available at https://webgate.ec.europa.eu/odr/main/index.cfm?event=main.home.chooseLanguage.
